The appellant, Carroll Gail White, was charged in a two count indictment with assault with intent to maim and assault and battery in the Circuit Court for Washington County. The charges arose out of appellants alleged participation in a riot at the Maryland Correctional Training Center, near Hagerstown, Maryland, on April 7, 1968. His motion for judgment of acquittal on the first count was granted and the jury found him guilty of assault and battery.
